Singapore Airlines Liability and Limitation

For Passengers and Baggage: These liability of SIA is limited in case of death, bodily injury, loss of or damage to baggage and for delay. These depend on whether the Montreal Protocol applies or the Warsaw Convention applies.

When Montreal Convention applies:

  • There is unlimited financial liability for death or bodily injury.  SIA does not contest the claims for compensation for damages upto 113100 SDR.

  • Destruction, loss, damage or delay of baggage, liability is limited at 1131 SDRs.

  • Delay to passengers, limitation of liability is placed at 4694 SDRs.

Where Warsaw Convention applies:

  • SIA does not contest the claims of up to 100000 SDRs for death or bodily injury. SIA has waived off the limits of 16600 SDRs or 8300 SDRs in cases respectively where the Hague Protocol to this Convention applies or only Warsaw Convention applies for causing death or bodily injury. This means that the carrier will be having unlimited liability.

  • In case of loss, damage and delay of checked baggage, 17 SDR per kg ($20/kg) )is required to be paid. For cabin baggage, 332 SDRs ($400) per passenger is the liability.

It is important to note that if the claim is arisen by the public insurance bodies then the waiver will not apply and SIA will contest the claim.

 

Time Limitations for notice of damaged luggage also exist. Notice of damage shall be brought to notice of carrier forthwith and latest within 7 days of receipt of luggage. In case there is delay in delivery of baggage to the passenger, he/she shall make complaint within 21 days of receiving the baggage.

Furthermore, there is also a limitation of initiation of action. No claims for damage to luggage would lie in case of expiry of 2 years from the date of arrival of the said flig
